Compassionate Release

Compassionate release is available post-sentencing and asks the sentencing judge to change the sentence to time served for “extraordinary and compelling” reasons. Compassionate release is not an easy thing to get, but our office has used it as a tool to try and get elderly and medically vulnerable people out of custody.

While a person does not need (and is not automatically entitled to) an attorney to file a compassionate release motion, our attorneys have and continue to file a number of these motions. We are prioritizing those who are most likely to be granted compassionate release, based on many factors, including age, health conditions, current conditions at the facility, and the percentage of the sentence served. We do welcome all inquiries regarding this option for relief, however.
